A Question...

Let me just set the scene a little bit first.
It's about 5:30 pm. Rush hour. It's raining. I'm on a fairly busy road and driving in the left hand lane of a 4 lane road. (That's 2 lanes going on each direction for those who may not know) Now since this is a busy road; it is normal for traffic to slow down, stop and move at the speed limit at any time.

So here is my question. If I were to accidentally hit someone, a pedestrian, "jay-walking", who would be at fault? This almost happend to me today on my drive home. The Only reason I did not hit him is because I was able to swerve into the other side of traffic to avoid him. Fortunately for us both there were not any cars coming at that particular time. There is absolutely no way I could have stopped in time. I would not have killed him or anything because I was only going about 20 or 25 mph and the posted speed is 30. He walked in front of an SUV which I could not see around and then directly into my path without even looking. My opinion is it wouldn't be my fault. A) He was "jay-walking" and B) I couldn't see him til he was directly in front of me. Therefor I say he was an Idiot!

Was that person text messaging on the cell phone? Hitting people who are crossing the street while text messaging adds bonus points.

Sometimes I think people who jay walk are doing it on purpose since for the most part pedestrians have the right of way according to the DMV. I seem to always get the big family of 10 walking to the Costco entrance blocking the entire pathway of the parking lot while I'm trying to find parking.
